Distance Sales Agreement

1. Parties

This Agreement has been signed between the following parties under the terms and conditions specified below.

By accepting this agreement, the BUYER irrevocably acknowledges and agrees that if they approve the order subject to the contract, they will be obligated to pay the price of the order and, if any, additional fees such as shipping costs and taxes, and that they have been informed of this.

2. Definitions

In the application and interpretation of this agreement, the terms written below shall express the written explanations opposite them.

MINISTER: The Minister of Customs and Trade, MINISTRY: The Ministry of Customs and Trade, LAW: The Law on Consumer Protection No. 6502, REGULATION: The Distance Sales Regulation, SERVICE: Any consumer transaction other than providing goods, made or promised to be made for a fee or benefit, SELLER: The company that offers goods to the consumer within the scope of its commercial or professional activities, or acts on behalf or account of the company that offers goods, BUYER: The real or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes, SITE: The internet site belonging to the SELLER, ORDERER: The real or legal person who requests a good or service through the internet site belonging to the SELLER, PARTIES: The SELLER and the BUYER, AGREEMENT: This agreement concluded between the SELLER and the BUYER, GOODS: Movable property subject to purchase and sale, and intangible goods such as software, audio, video, and similar items prepared for use in electronic environments,

3. Subject

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Distance Sales Regulation regarding the sale and delivery of the product, whose qualities and sales price are specified below, which the BUYER has ordered electronically through the SELLER’s internet site.

The prices listed and announced on the site are sales prices. Announced prices and promises are valid until they are updated and changed. Prices announced for a limited period are valid until the end of the specified period.

7. Information Regarding the Product(s) Subject to the Agreement

7.1. The basic characteristics of the goods/product(s)/service (type, quantity, brand/model, color, number) are published on the SELLER’s internet site. If the SELLER has organized a campaign, you can examine the basic features of the relevant product during the campaign period. It is valid until the campaign date.

7.2. Prices The prices listed and announced on the site are sales prices. Announced prices and promises are valid until they are updated and changed. Prices announced for a limited period are valid until the end of the specified period.

8. Invoice Information

9. General Provisions

9.1. Information and Acceptance The BUYER acknowledges, declares, and undertakes that they have read the preliminary information regarding the basic qualities, sales price, payment method, and delivery of the product subject to the contract on the SELLER’s internet site, and have given the necessary confirmation in electronic environment.

9.2. Delivery Period Each product subject to the contract is delivered within the period specified in the preliminary information section of the website, depending on the distance of the BUYER’s place of residence, provided that it does not exceed the legal period of 30 days.

10. Right of Withdrawal

In the case of distance contracts concerning the sale of goods, the BUYER may exercise the right to withdraw from the contract by rejecting the goods without any justification, provided that they notify the SELLER within 14 days from the date of delivery of the product to themselves or to the person/organization at the address they indicated.

11. Products for Which the Right of Withdrawal Cannot Be Exercised

Products prepared in line with the BUYER’s wishes or explicit personal needs, such as bottom parts of underwear, make-up products, and single-use products, are excluded from the scope of the right of withdrawal.

12. Default and Legal Consequences

If the BUYER defaults on payment transactions made with a credit card, they accept, declare, and undertake that they will pay interest within the framework of the credit card agreement with the cardholder bank and will be responsible to the bank.

13. Authorized Court

In disputes arising from this agreement, complaints and objections will be made to the consumer arbitration committee or consumer court at the consumer’s place of residence or where the consumer transaction took place.

14. Effectiveness

The BUYER is deemed to have accepted all the terms of this agreement when they make the payment for the order placed through the Site.
