Consumer Rights – Withdrawal – Cancellation and Refund Conditions

By placing an order electronically through this website, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.

Buyers are subject to the provisions of the Law on Consumer Protection No. 6502, the Distance Sales Regulations (Official Gazette: 27.11.2014/29188), and other applicable laws regarding the sale and delivery of the product they purchase.

Shipping costs for product shipments will be paid by the buyers.

Each purchased product will be delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.

The purchased product must be delivered complete, in accordance with the specifications stated in the order, and with any warranty certificate and user manual, if applicable.

If the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days of becoming aware of this situation. The total amount must be refunded to the buyer within 14 days.

If the Purchased Product Price Is Not Paid

If the buyer fails to pay the price of the purchased product or cancels it in bank records, the seller’s obligation to deliver the product ceases.

Purchases Made with Unauthorized Credit Card Use

If it is determined after the product is delivered that the credit card used by the buyer for payment was unlawfully used by unauthorized persons, and the product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the product subject to the contract to the seller within 3 days, with shipping costs borne by the seller.

If the Product Cannot Be Delivered on Time Due to Unforeseen Circumstances

If unforeseen circumstances beyond the seller’s control occur and the product cannot be delivered on time, the buyer will be notified. The buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the buyer cancels the order, and the payment was made in cash, the amount will be refunded in cash within 14 days of cancellation. If the buyer paid by credit card and cancels, the product amount will be refunded to the bank within 14 days of cancellation, but it is possible for the bank to transfer the amount to the buyer’s account within 2-3 weeks.

Buyer’s Obligation to Inspect the Product

Before receiving the goods/services subject to the contract, the buyer will inspect them; they will not accept damaged or defective goods/services such as dents, breakages, torn packaging, etc., from the shipping company. It will be assumed that the received goods/services are undamaged and intact. After delivery, the buyer must carefully protect the goods/services. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned with the product.

Right of Withdrawal

The buyer has the right to withdraw from the contract by rejecting the goods without assuming any legal or criminal liability and without giving any reason, provided that they notify the seller via the communication details below within 14 (fourteen) days from the date of delivery of the purchased product to them or to the person/organization at the address they indicated.

Duration of the Right of Withdrawal

If the purchased item is a service, this 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised for service contracts where the performance of the service has started with the consumer’s consent before the withdrawal period expires.

Expenses arising from the exercise of the right of withdrawal belong to the seller.

To exercise the right of withdrawal, a written notification must be sent to the seller by registered mail with return receipt, fax, or email within the 14 (fourteen) day period, and the product must not have been used within the framework of the “Products for which the Right of Withdrawal Cannot Be Exercised” provisions regulated in this contract.

Exercise of the Right of Withdrawal

The invoice for the product delivered to the third party or the buyer, (If the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the company. Order returns issued in the name of institutions cannot be completed unless a return invoice is issued.)

The return form, the box of the products to be returned, packaging, and any standard accessories must be delivered complete and undamaged.

Return Conditions

The seller is obliged to refund the total amount and the documents that put the buyer in debt to the buyer within a maximum of 10 days from the date of receipt of the withdrawal notification, and to take back the goods within 20 days.

If there is a decrease in the value of the goods due to a fault of the buyer or if the return becomes impossible, the buyer is obliged to compensate the seller’s damages in proportion to their fault. However, the buyer is not responsible for changes and deteriorations that occur due to the proper use of the goods or product within the right of withdrawal period.

If the campaign limit amount set by the seller is fallen below due to the exercise of the right of withdrawal, the discount amount benefited from within the scope of the campaign will be canceled.

Products for Which the Right of Withdrawal Cannot Be Exercised

The right of withdrawal cannot be exercised for products prepared in line with the buyer’s wishes or explicit personal needs and are not suitable for return, such as bottom parts of underwear, swimwear and bikini bottoms, make-up products, single-use products, goods that are perishable or may expire quickly, products that are not suitable for return in terms of health and hygiene if their packaging is opened by the buyer after delivery, products that are mixed with other products after delivery and cannot be separated due to their nature, goods related to periodicals such as newspapers and magazines, except for those provided under a subscription contract, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and if the packaging of audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables is opened by the buyer, return is not possible according to the Regulation. Furthermore, according to the Regulation, it is not possible to exercise the right of withdrawal for services whose performance has started with the consumer’s consent before the right of withdrawal period expires.

For cosmetic and personal care products, underwear products, swimwear, bikinis, books, copyable software and programs, DVD, VCD, CD and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.), their packaging must be unopened, untried, undamaged, and unused for them to be returned.

Default and Legal Consequences

If the buyer defaults on payment transactions made with a credit card, they accept, declare, and undertake to pay interest within the framework of the credit card agreement with the cardholder bank and be responsible to the bank. In this case, the relevant bank may resort to legal remedies; it may demand the resulting expenses and attorney’s fees from the buyer, and in any case, if the buyer defaults on their debt, the buyer agrees to pay the loss and damage suffered by the seller due to the delayed performance of the debt.
